1. General

These General Terms and Conditions of Sale (the “Terms and Conditions”) apply to all orders placed and all sales concluded through the website www.heloukids.be, in relation to the Products offered on this website (the “Products”).

The website www.heloukids.be is owned and operated by CTC, with registered office at Omer van Ommerplein 1, 2650 Edegem, Belgium, registered with the Crossroads Bank for Enterprises under number BE0784.555.794, acting as the seller of the Products (the “Seller”).

By placing an order on www.heloukids.be, you confirm that you have read and accepted these Terms and Conditions without reservation.

We may occasionally update these Terms and Conditions to reflect changes in our business or in the law. Any updated version will apply only to orders placed after it has been published on the website.

2. Placing an Order

To place an order on our website, you confirm that:

  • the information you provide is complete and accurate;

  • you are at least 18 years old or have the consent of a legal guardian;

  • you are authorised to use the selected payment method.

If you choose to create an account, you are responsible for keeping your login details confidential. Orders placed using your account will be deemed to have been made by you.

Placing an order on the website involves the following simple steps:

  1. Selecting the Products you love;

  2. Entering your delivery and billing details;

  3. Completing payment;

  4. Receiving an order confirmation by e-mail;

  5. Shipment of your Products;

  6. Delivery to your chosen address.

3. Order Confirmation & Acceptance

Orders placed on our website are subject to acceptance by the Seller. An automatic confirmation e-mail confirms receipt of your order but does not yet constitute acceptance.

Your order is accepted and the sales contract is concluded once the Products have been dispatched to you.

We reserve the right to refuse or cancel an order prior to dispatch in situations such as:

  • a technical or pricing error;

  • Product unavailability;

  • incorrect or unverifiable billing details;

  • suspected fraud or misuse;

  • reasonable doubt regarding the customer’s age.

If an order is cancelled, any amounts already paid will be refunded promptly.

4. Prices, Delivery & Taxes

All prices displayed on www.heloukids.be are inclusive of VAT and apply exclusively to online orders. VAT is applied in accordance with Belgian and European VAT regulations.

Delivery costs and any additional charges are clearly displayed before finalising your order.

Delivery times are indicative and provided as a guide. We always do our utmost to ship your order as quickly as possible. We try to deliver ordered Products on time. Instances can, however, occur wherein we are prevented from dispatching the Products on time and from meeting our indicated delivery time. Any delivery time specified by us should therefore be considered as a non-binding estimate and not as an obligation to achieve the result of delivering the Products on the estimated delivery date.

Shipping details and rates per country are available on the website. If your country is not listed, feel free to contact us — we are happy to help. In any event, delivery shall take place no later than 30 days after conclusion of the sales contract, unless otherwise expressly agreed.

5. Availability

While we strive to keep our website up to date, some Products may occasionally be unavailable. We reserve the right to modify or remove Products at any time.

Please inspect your delivery shortly after receipt. Should anything be missing or damaged, kindly contact us as soon as possible so we can assist you.

If delivery cannot be completed due to an incorrect address or prolonged non-collection, we may treat the order as cancelled and issue a refund in accordance with applicable law.

6. Product Images

We do our best to present our Products as accurately as possible. Colours may vary slightly due to screen settings and display differences.

7. Payment

Payments are processed securely via the payment methods offered on the website at the time of purchase. Your order will be dispatched once payment has been successfully authorised.

8. Returns

If you have purchased Products as a consumer for your own personal use, you have the legal right to withdraw from your purchase within 14 days, from the day you received the Products.

To do so, simply send an e-mail to info@heloukids.be within this period. We will guide you through the return process.

We recommend using a track-and-trace service for your return. The return shipment remains the responsibility of the customer; Hélou Kids cannot be held liable for return parcels lost in transit.

To ensure a smooth return, Products must be sent back complete, unworn, unwashed, and in the same condition in which they were received, allowing only the handling necessary to try on and assess the item. Please return all Products in their original packaging, with labels and hangtags still attached.

Refunds are processed within 14 days of your withdrawal request, once the returned Products have been received or proof of return has been provided. Original delivery costs are not refunded. Return shipping costs are paid by the customer.

Returns that do not meet the above conditions may be refused or may result in a partial refund to reflect any loss in value or handling costs.

9. Circumstances Beyond Our Control

We are not liable for delays or failures caused by circumstances beyond our reasonable control. In such cases, we will fulfil our obligations as soon as reasonably possible.

10. Liability

Nothing in these Terms and Conditions affects your statutory consumer rights. We do not exclude or limit liability where such limitation is not permitted under Belgian or European law.

11. Personal Data

Your personal data are processed with care and in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable Belgian law. Please refer to our Privacy Policy for more details.

13. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
